Remind the Colorado Springs City Council that they took an OATH to the Colorado Constitution and that it is their job to protect the rights of the people, according to Article 2, the Colorado Bill of Rights!

Colorado Springs City Council - Protect Our Rights!

Dear City Council Members and Staff,

During this difficult time, we hope this message finds you and your family well but I would like to remind you of the sections of the Colorado Constitution (i.e., Supreme Law of the state) which protect my property rights and I expect you to make decisions that protect ALL of my rights, including the right to refuse wearing a mask.

Article 2, Section 1 clearly states, “All political power is vested in and derived from the people; all government, of right, originates from the people, is founded upon their will only, and is instituted solely for the good of the whole.”

Section 3 says, “All persons have certain natural, essential and inalienable rights, among which may be reckoned the right of enjoying and defending their lives and liberties; of acquiring, possessing and protecting property; and of seeking and obtaining their safety and happiness.”

Section 7 describes how, "The people shall be secure in their persons, papers, homes and effects, from unreasonable searches and seizures; and no warrant to search any place or seize any person or things shall issue without describing the place to be searched, or the person or thing to be seized, as near as may be, nor without probable cause, supported by oath or affirmation reduced to writing."

Section 14 reads as, “Taking private property for private use. Private property shall not be taken for private use unless by consent of the owner, except for private ways of necessity, and except for reservoirs, drains, flumes or ditches on or across the lands of others, for agricultural, mining, milling, domestic or sanitary purposes." and

Section 15 says, “whenever an attempt is made to take private property for a use alleged to be public, the question whether the contemplated use be really public shall be a judicial question, and determined as such without regard to any legislative assertion that the use is public.”

My property also includes my body and my thoughts as defined in the section of the security of my person (7), so in being clear with the Supreme Law of our state, please remember that you have no authority to shut down my business (sections 14 & 15) nor to tell me what to do with my own body (including forced mask wearing, contact tracing, nor vaccines) without due process of the law.

The history of our great state and the fact that Article 2, Section 1 states how "all political power is vested in the people" should be enough evidence to remind you of how your authority comes from the people, NOT public health agencies. The draconian sanctions that are being placed onto the people by health agencies and the Colorado Department of Public Health and Environment (CDPHE), along with the illegal actions from the Governor, without public notice, hearing, nor appeals is nothing short of a criminal action. Labels such as "essential" and "non-essential" as deemed by such agencies are arbitrary and capricious, at best...and criminal, at worst.

Why are you handing your elected authority over to a non-profit agency that has only issued an "advisory" for these draconian sanctions? Are you sure that you want to lose your authority in that manner while also breaking the law?

I do not come to speak to you to plead for our natural, ESSENTIAL, inalienable rights. I also do not ask you to plead to the Governor on our behalf. For we the people of Colorado do not plead for our rights but rather we assert them. I come here to respectfully demand that you, our local representatives, recognize and protect our rights. The Governor of Colorado has attempted to strip us of our freedom and property rights. However, it is your DUTY to not comply with his “color of law” order. The Governor does not have the authority to simply decree orders infringing on our freedom and our rights enumerated in the Colorado Constitution. Remember the Colorado Constitution is the Supreme Law of the state no matter who is Governor or what he says. This is the same Constitution YOU took an oath to defend and it is YOUR DUTY to the people of this county to not implement the Governors illegal orders but rather to denounce them. Article 2, Section 1 of the Colorado Constitution clearly states, “All political power is vested in and derived from the people; all government, of right, originates from the people, is founded upon their will only, and is instituted solely for the good of the whole.” Article 2, Section 3 says, “All persons have certain natural, ESSENTIAL, and inalienable rights, among which may be reckoned the right of enjoying and defending their lives and liberties; of acquiring, possessing and protecting property; and of seeking and obtaining their safety and happiness.” Natural, ESSENTIAL, and inalienable rights DO NOT CHANGE based on circumstance. Asking FOR PERMISSION from the Governor to be free and exercise property rights is NOT acceptable. Asking FOR PERMISSION from our Governor to run a business, work jobs to provide for our families, gather to worship, engage in commerce, recreate, or otherwise peacefully assemble is NOT acceptable. You need to be LEADERS and show COURAGE by standing up to our lawless Governor. You need to be leaders and HONOR your oath. You need to be leaders and RECOGNIZE and PROTECT the Colorado Constitution even when the Governor of this great state refuses to do so. The people of El Paso County are counting on you to protect our rights and our livelihoods. The people of this county should be defended by our local representatives, cause otherwise…why are you even here? Represent us well El Paso County Commissioners. Be leaders. Show courage. You are in this position for such a time. Don’t be bribed with funding. Tell the Governor, El Paso County is free and open now. If you don’t, then we the people of El Paso County will. And I hope you hear that message loud and clear today.

County Commissioners,

I stand representing “Free Counties” of freecounties.com and we would like to remind you of a term that is foreign to most people these days and that is “Federalism.” It’s a solid principle our Republic was founded upon and, although, we live in an upside-down world right now, this principle is still protected by the Colorado Constitution and the U.S. Constitution which are the Supreme Laws of the land.

“Federalism” is the structure of how governing bodies obtain their authority, including yours. If this structure is absent, then anarchy and chaos would be the result or…the complete opposite which is total tyranny over all. A quick look at history shows how “federalism” is where ALL power lies in the hands of the people, then the local governments under them, then the state, and at the very bottom is the Federal government with extremely limited powers. The Rule of Law is written in this manner and although some tyrants are hoping people ignore it, the fact is that it is the law you are all bound to uphold.

During this COVID-19 scare, County Commissioners are taking directions from public health agencies instead of abiding by the Rule of Law and protecting the rights of the people. This poor decision could result in bad policies for the people of our county. The ideas being pushed down from the CDC and other entities of the Federal government, and the Governor, onto local health agencies of social distancing, forced mask wearing, mandatory testing at resident’s homes, and contact tracing are nothing more than suggested “rules” but are in complete violation of Article 2 of the Colorado Constitution, the Colorado Bill of Rights. Article 2, Sections 1, 3, 7, 14, & 15 explain how ALL political power is vested in the people and that governments only have authority from the consent of the governed and that property rights of the people must be protected and no governing body can infringe upon them without just compensation. Section 7 specifically describes how, “The people shall be secure in their persons, papers, homes and effects, from unreasonable searches and seizures.”

The county health department has no authority to infringe upon the rights of the people in the manner of placing people on house arrest, forcing them to do things with their bodies, nor tracing other people they come in contact with during their personal lives!

These health agencies should not be above the supreme law and neither should you. You are bound to abide by the Colorado Constitution you took an oath to uphold which says that due process MUST be followed at ALL times (Section 25). If you are considering any of these suggestions from the county health department, please show us where they went through due process of the law first before deeming themselves these draconian powers over the people.

Labels such as “essential,” “non-essential,” and “contact tracing” are arbitrary and capricious and are criminal without any public notice, hearing, nor appeals processes.

Why are you giving your state statutory power over to the local health agency without the consent of the people of El Paso County?
